Seller and contact

The Seller operating Mira Atelier at https://mira-atelier.com is Mira Martyna Feter, a sole trader entered in Poland’s Central Registration and Information on Business (CEIDG).

Mira Martyna Feter is the producer of the works offered under the Mira Atelier brand and the organiser of the workshops.

General provisions

These terms govern the use of the Mira Atelier website, contracts for artworks, ceramics and workshop places, and electronic services including the cart, order page and newsletter.

An up-to-date browser, Internet access and an active e-mail address are required. Unlawful content, security circumvention and infringements of third-party rights are prohibited.

Offer and contract

Product and workshop information is an invitation to enter into a contract. The customer selects items, payment and delivery, supplies data, accepts the applicable document versions and uses the button clearly indicating an obligation to pay.

Before ordering, the customer sees the main characteristics, total price including taxes, delivery cost, payment and performance terms and delivery restrictions. Confirmation and contract terms are sent by e-mail on a durable medium.

The contract is concluded when the customer receives an e-mail expressly confirming acceptance of the order. The initial e-mail acknowledging that an order has been received and recorded confirms only receipt and a temporary reservation; it is neither acceptance of the offer nor confirmation of payment.

For online payments or regular bank transfers, the acceptance message is sent after the required initial payment and availability of the ordered items have been confirmed. Where a workshop offer permits a deposit, that deposit is the required initial payment; the balance deadline is stated in the offer and order. For cash, acceptance is confirmed by a separate e-mail accepting the reservation or, if no such message has previously been sent, by an e-mail confirming acceptance after the cash payment is recorded.

Prices and availability

Prices are in PLN and include applicable taxes according to the Seller’s tax status. Delivery is shown separately before ordering. A communicated price reduction includes the lowest price during the preceding 30 days where required by law.

A one-off work can be purchased only once. A temporary reservation does not guarantee a purchase after it expires.

Intellectual property

Photographs, texts, the logo and works are protected. Buying a work does not transfer copyright or a commercial reproduction licence unless separately agreed.

Versions

The version accepted with the order applies to that order. Its identifier and cryptographic hash are recorded. Later changes do not affect acquired rights.

Electronic services

Browsing the offer and using the cart and order page are free. You may stop using these functions by leaving the website; this does not cancel an order already placed. You can unsubscribe from the newsletter using the link in an e-mail. Separate newsletter terms apply.

Payments

Online payment services are provided by Autopay S.A. The customer is redirected to the payment provider’s website. Card details are entered on that website, not in the shop’s forms.

Payment methods include the following payment cards: Visa, Visa Electron, Mastercard, MasterCard Electronic, Maestro, as well as other methods offered by Autopay. Customers can select only the methods available for their particular order at checkout. Online payments and individual methods depend on activation by the shop and the payment provider.

Cash is available for studio collection and workshops when selected during checkout. A regular bank transfer is available only if checkout offers it and provides the transfer details.

For card payments, the fulfilment period starts with successful payment authorisation. For other online payments it starts when the provider confirms payment; for a regular bank transfer, when the funds are credited. Returning to the shop from the payment gateway alone does not confirm payment.

After an interrupted or unsuccessful payment, customers can return to payment through their order page or the link in the order e-mail while the order remains payable and its reservation has not expired. The reservation deadline is shown with the order.

Delivery and studio collection

Customers can choose free studio collection or delivery to an address arranged by the Seller. The Seller selects the carrier; the shop does not offer parcel-locker selection or a choice of carrier.

The delivery charge is displayed with the product and before the order is placed. For an order containing several items, the charge is the sum of the delivery rates for all ordered units. A charge of PLN 0 means delivery without an additional fee. Product prices are final prices in PLN including applicable taxes; any delivery charge is added separately.

Delivery is available to the countries listed at checkout. Currently these are Poland, Austria, Belgium, Bulgaria, Croatia, Czechia, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, the Netherlands, Portugal, Romania, Slovakia, Slovenia, Spain and Sweden. Checkout does not accept delivery orders to other countries.

Ready-made works are dispatched within 5 working days of payment confirmation (for cards: successful authorisation). Delivery after dispatch takes 1–3 working days within Poland and 3–10 working days to the other supported countries. The total fulfilment period is therefore up to 8 working days within Poland and up to 15 working days abroad. Studio collection is prepared within 3 working days of payment confirmation or, for cash, acceptance of the order by the Seller. We notify the customer when collection is ready. Working days are Monday to Friday, excluding Polish public holidays. The completion and delivery date for an individually commissioned work is agreed with the customer before the contract is concluded.

Workshops take place on the date and at the venue stated in the offer and order. Admission passes are electronic and do not require physical shipment.

The Seller remains responsible to consumers for transport by the carrier selected by the Seller. Documenting damage helps with a complaint, but a carrier’s damage report is not a condition of statutory rights.

Withdrawal and refunds

Consumers may withdraw from an online purchase of a ready-made, non-personalised work without giving a reason within 14 days of receipt. Where a single contract covers goods delivered separately, the period starts upon receipt of the last item. Being unique or an artwork does not itself exclude withdrawal rights.

For a service contract, including a workshop to which no statutory exception applies, the 14-day withdrawal period starts on the day the contract is concluded. Stating a workshop date does not by itself establish that the conditions of an exception are met.

To meet the deadline, send a clear statement to mira@mira-atelier.com or the Seller’s address before the period ends. The form on the “Withdrawal” page is optional. Goods must be sent back to the Seller’s address within 14 days of giving notice. Dispatch before the deadline is sufficient.

The Seller refunds the payment received, including the cost of the least expensive standard delivery offered for that order, within 14 days of receiving the withdrawal notice. Unless the Seller offers to collect the goods, the refund may be withheld until the goods or evidence of dispatch are received, whichever is earlier.

Refunds use the original payment method. Card payments are refunded to the account linked to that card. Another method requires the consumer’s express agreement and must be free of charge.

The consumer bears the direct cost of returning goods that can normally be sent by post. For a work requiring special transport, the cost or a reasonable maximum estimate of return costs must be disclosed before the contract is concluded. If this information was not provided, the Seller bears the return cost; please contact us to arrange collection. Consumers do not bear return costs that were not disclosed as required by law.

The consumer is responsible for diminished value caused by handling beyond what is needed to establish the goods’ nature, characteristics and functioning. The exception for leisure-related services or cultural events on a specified date (Article 38(1)(12) of the Polish Consumer Rights Act) applies to a workshop only where the statutory conditions are met and the customer was informed of the exclusion before purchase.

The right of withdrawal does not apply to non-prefabricated goods made to the consumer’s specifications or to meet their individual needs (Article 38(1)(3) of the Polish Consumer Rights Act), for example a painting commissioned to the customer’s agreed individual requirements. Selecting a ready-made work from the catalogue, its handmade or unique nature, or its artistic character does not exclude withdrawal rights. Any applicable exclusion is disclosed before the contract is concluded. It does not restrict the right to complain about goods that do not conform to the contract.

Complaints and guarantees

Complaints about goods, workshops or the website can be sent to mira@mira-atelier.com or the Seller’s address. Please describe the problem, the remedy sought and information identifying the order. A receipt is not the only acceptable proof of purchase.

The Seller is responsible for a lack of conformity revealed within two years of delivery. Consumers may request repair or replacement and, where the law permits, a price reduction or termination of the contract. The Seller bears the costs of conformity remedies. Consumer complaints are answered within 14 days of receipt.

A commercial guarantee applies only where and on the terms provided for a specific product. It does not restrict the Seller’s statutory responsibility. Consumer protections also apply to sole traders to the extent required by law.

Consumers may seek free assistance from their local consumer ombudsman and use out-of-court complaint and redress procedures, including proceedings before the Polish Trade Inspection. Information on available bodies and procedures is provided at https://polubowne.uokik.gov.pl/. The Seller’s participation is subject to any consent required by law; these terms do not constitute general consent to every procedure. If a complaint does not resolve the dispute, the Seller provides the information and statement required by law on a durable medium.

Personal data

The personal data controller is the Seller, Mira Martyna Feter. We process your name, e-mail, any telephone number you provide, billing and delivery addresses, company and tax details where needed for an invoice, and information about your order, payment and refund. For workshops we also process participant names, reservations and attendance confirmations. We record accepted document versions, the time of acceptance and technical data needed for security and evidence of declarations, including the IP address and browser information.

Data needed to enter into and perform a contract, process payment and delivery, and provide workshop participation are processed under Article 6(1)(b) GDPR. Records required by tax, accounting and consumer protection law are processed under Article 6(1)(c) GDPR. Security, fraud prevention, evidence of declarations and the establishment, exercise or defence of claims are legitimate interests under Article 6(1)(f) GDPR. The optional newsletter relies on consent under Article 6(1)(a) GDPR; consent is not a condition of purchase and can be withdrawn.

For online payments, Autopay S.A. receives the necessary transaction data, including the e-mail address, order identifier, amount and currency. The shop does not receive your card number or security code. Other recipients, retention periods, cookie use and your rights are explained in the Privacy and Cookies Policy.
